Privacy policy

This Privacy Policy explains how DECIDE Pty Ltd (trading as HEMP PET, "we," "us," or "our") collects, uses, discloses, and protects your personal information when you access or use our wholesale portal at hemppet.au (the "Portal"). The Portal is a business-to-business (B2B) platform operating exclusively in Australia, serving veterinary professionals, clinics, wholesalers, and retailers in the pet health and nutrition sector. We are committed to complying with Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), as well as the Spam Act 2003 (Cth) for electronic marketing communications.

If you do not agree with this Privacy Policy, please do not access or use the Portal.

Personal Information We Collect

"Personal information" has the meaning given in the Privacy Act 1988 and includes information or an opinion about an identified individual, or an individual who is reasonably identifiable.

We collect personal information that is reasonably necessary for our business functions, such as providing wholesale access to hemp-based pet products, veterinary resources, and related services. The types of personal information we may collect include:

- Contact and Business Details: Your name, job title, business email address, phone number, company name, Australian Business Number (ABN), billing address, shipping address, and other professional contact information.

- Account Information: Username, password (stored securely), and preferences related to your wholesale account.

- Order and Transaction Information: Details of wholesale orders, including products purchased, quantities, payment information (e.g., credit card or bank details processed securely via third-party providers), invoices, and delivery details.

- Device and Usage Information: Automatically collected data such as your IP address, browser type, device type, operating system, time zone, pages viewed, referral sources, and interactions with the Portal (e.g., via cookies, log files, or pixels).

- Marketing Preferences: Information about your consent to receive marketing materials, including records of opt-ins and opt-outs.

- Other Information: Any additional details you provide voluntarily, such as feedback, inquiries, or communications with our team.

We do not collect sensitive information (e.g., health data) unless it is directly relevant to our veterinary-focused services and you provide it voluntarily with consent.

How We Collect Your Personal Information

We collect personal information in the following ways:

- Directly from You: When you create a wholesale account, place an order, subscribe to updates, contact us via email or the Portal's forms, or interact with our customer support.

- Automatically: Through technologies like cookies, web beacons, and log files as you browse the Portal. You can manage cookie preferences via your browser settings (see http://www.allaboutcookies.org for more information).

- From Third Parties: From business partners, payment processors, or analytics providers (e.g., Shopify, which powers the Portal) where necessary for our operations. We may also receive information from veterinary associations or wholesalers if you are referred to us.

- Public Sources: Business directories or professional networks relevant to the veterinary sector.

We only collect personal information by lawful and fair means, and we will notify you of the collection at or before the time it occurs (or as soon as practicable afterward) in accordance with APP 5.

How We Use Your Personal Information

We use your personal information for the primary purpose for which it was collected, or for related secondary purposes that you would reasonably expect. These include:

- Managing your wholesale account and providing access to the Portal.

- Processing and fulfilling wholesale orders, including payment processing, shipping, invoicing, and order confirmations.

- Communicating with you about your account, orders, or inquiries.

- Improving the Portal through analytics (e.g., understanding how veterinary professionals interact with product resources).

- Screening for fraud, risk, or compliance with legal obligations.

- Internal business purposes, such as auditing, research, and quality assurance in the pet health sector.

- With your consent, sending marketing communications (see the section below).

We will not use your personal information for unrelated purposes without your consent or as permitted by law.

Consent for Marketing Communications

In compliance with the Spam Act 2003, we only send commercial electronic messages (e.g., emails about wholesale products, veterinary resources, business offers, or partner updates) with your express consent.

- How We Obtain Consent: During account registration or at other points of interaction, you may opt in via an unticked checkbox. For example: "Yes, I'd like to receive updates on products, offers and veterinary professional resources”. Consent is voluntary, specific, informed, and can be withdrawn at any time.

- What Marketing Involves: Communications may include newsletters on hemp-based pet nutrition, exclusive wholesale deals, regulatory updates for veterinarians, or promotions from trusted partners in the Australian veterinary space. We do not send unsolicited spam.

- Opting Out: Every marketing email includes a clear unsubscribe link. You can also withdraw consent by contacting us (see Contact Us below). We will process opt-out requests promptly, typically within 5 business days.

- Records: We maintain records of your consent to ensure compliance.

If you do not opt in, you will still receive transactional communications (e.g., order confirmations) necessary for our business relationship.

Sharing Your Personal Information

We may disclose your personal information to third parties where necessary for our business operations or as required by law. Disclosures are limited to what is reasonably necessary and compliant with the APPs. Recipients may include:

- Service Providers: Third parties like Shopify (for hosting the Portal), payment gateways (e.g., for secure transactions), logistics providers (for shipping wholesale orders), and analytics tools (e.g., Google Analytics, with opt-out available at https://tools.google.com/dlpage/gaoptout).

- Business Partners: Trusted partners in the Australian veterinary sector (e.g., for joint webinars or product collaborations), only with your consent where required.

- Professional Advisors: Accountants, lawyers, or auditors for business compliance.

- Regulatory Authorities: To comply with Australian laws, such as responding to requests from the Office of the Australian Information Commissioner (OAIC), Australian Competition and Consumer Commission (ACCC), or courts.

We do not sell your personal information. All third parties are required to handle your information securely and in accordance with Australian privacy laws. Data is stored in Australia where possible; any international transfers (e.g., to Shopify's servers in Canada or the US) are subject to appropriate safeguards under APP 8.

Data Security

We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorized access, modification, or disclosure, in line with APP 11. Measures include encryption, secure servers, access controls, and regular security audits. Payment details are processed via PCI DSS-compliant providers and not stored on our systems.

Despite these measures, no online transmission is completely secure. If a data breach occurs involving personal information, we will comply with the Notifiable Data Breaches scheme under the Privacy Act.

Access, Correction, and Deletion

Under APP 12 and 13, you have the right to:

- Access your personal information we hold (subject to exceptions, e.g., legal privileges).

- Request corrections if it is inaccurate, out-of-date, incomplete, irrelevant, or misleading.

- Request deletion where we no longer need it for permitted purposes.

Requests should be made in writing (see Contact Us). We will respond within a reasonable period (usually 30 days) and may charge a reasonable fee for access if substantial work is involved. If we refuse a request, we will provide reasons and information on complaint options.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes outlined in this Policy, comply with legal obligations (e.g., tax records for 7 years), or resolve disputes. For example, order information is kept for accounting purposes. When no longer needed, we securely delete or anonymize it.

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. Changes will be posted on the Portal with the updated effective date. Continued use of the Portal after changes constitutes acceptance.
